Overbooking occurs when airlines sell more tickets than available seats, hoping that some passengers won't show up. If you find yourself in a situation where you're denied boarding after volunteering to give up your seat, here are your rights:

  • Compensation ranging from €125 to €600, depending on the flight distance.
  • Assistance during your wait, including meals, beverages, phone calls, and even hotel stays if necessary.

It's important to note that compensation can be halved if the alternative transport offered allows you to reach your destination with a delay of 2 to 4 hours, depending on the flight distance. The solution can be either a full refund or alternative transport, along with any applicable compensation.

Cancellation Due to External Factors

External factors that can lead to flight cancellations typically include severe weather conditions, political instability, or other events classified as "force majeure." In such cases, the airline must provide one of the following solutions:

  • Refund of the ticket price, and if applicable, free return to your initial departure point.
  • Rescheduling your flight to a date that is convenient for you, subject to seat availability.

If the next flight is scheduled for the following day, the airline must provide a complimentary hotel stay and transportation to and from the airport. Additionally, you have the right to receive attention in the form of meals, beverages, and phone calls.

Cancellation for Personal Reasons

In cases where the airline cancels a flight for its own reasons, passengers retain the same rights as in overbooking situations (refund or alternative transport + assistance + compensation). However, compensation may not be applicable under certain conditions:

  • Cancellations due to external factors, as previously mentioned.
  • Notification of cancellation at least 14 days in advance.
  • Notification between 14 and 7 days in advance, with an alternative flight that does not depart more than 2 hours earlier or arrive more than 4 hours later than the original booking.
  • Notification less than 7 days in advance, with a proposed alternative flight that does not depart more than 1 hour earlier or arrive more than 2 hours later than the original booking.

You can seek a refund of your ticket or alternative transport, along with any applicable compensation.

Flight Delays: Your Rights

When a flight is delayed, passengers have several rights, including:

  • Assistance with meals, beverages, phone calls, and accommodation for overnight delays. This assistance is provided for delays of:
    • 2 hours or more for flights of 1,500 kilometers or less.
    • 3 hours or more for intra-community flights over 1,500 kilometers and for all flights between 1,500 and 3,500 kilometers.
    • 4 hours or more for other flights.
  • Refund of ticket price for delays exceeding 5 hours.
  • Compensation for arrivals delayed by more than 3 hours, although amounts may not be defined in current regulations, you still have this right.

The solution in these cases can be a full refund of your ticket or, in some cases, compensation.

Lost or Damaged Luggage

There's nothing more stressful than waiting for your luggage at the carousel only to realize it's missing. If your bag doesn’t appear, you might find yourself in a situation where you can claim up to €1,220 for lost or damaged luggage. The final amount is determined by international agreements, but you are entitled to some form of compensation.

You can declare a special value for your luggage before boarding, which would increase the compensation amount in case of loss or damage, but this comes with an additional fee.

In any of the situations mentioned, you should file a complaint with the airline. If you don’t receive a satisfactory response within a reasonable timeframe, you can escalate your complaint to the Spanish Aviation Safety Agency (visit their website for more information), where you'll find the necessary forms to submit alongside a copy of your airline complaint.

Alternatively, consider engaging a specialized company that advocates for your rights and is more experienced in dealing with these issues.
